Abstract

Manpower which is a human resource is a very valuable asset in the company, because the workforce has a role and position as actors and processors of resources in the company and can add important points in national development. Without human labor or employees, it will affect the processing of resources within the company which results in no profit for the company, in other words, the company will lose money. PT. Sam Kyung Jaya Garments is a garment industry, which is a business that is engaged in producing textile goods such as apparel. The garment industry requires more employees to produce clothes in very large quantities. The purpose of this research is to know the process of permanent employment agreement, regulation of rights and obligations and legal responsibilities between PT. Sam Kyung Jaya Garments with permanent workers in doing the job. The method in this study is a normative approach, because in this study the author will examine norms or regulations, legal principles related to legal responsibility between PT. Sam Kyung Jaya Garments with Permanent Workers in Doing the Work. This research is descriptive because it provides a real picture of legal responsibilities and the implementation of permanent workers' work agreements. The results show that before the agreement occurs, the prospective worker must pass the administrative selection and meet the legal requirements of the agreement according to Law No. 13 of 2003 Article 52, namely agreement, skill, a certain thing and a lawful cause. The agreement occurs when both parties sign a letter of agreement, then a legal relationship arises to carry out rights and obligations. Here workers are obliged to do their jobs, obey regulations, and obey company agreements, and get their rights, namely wages, days off, BPJS. While the company or PT. Sam Kyung Jaya Garments is obliged to pay workers wages, guarantee safety, provide days of leave to permanent workers, PT. Sam Kyung Jaya Garments has the right to get good and good results of work and fulfillment of production targets. If one of the parties does not carry out its obligations in the work agreement, then the party who does not carry out its obligations must be responsible on the basis of default. And if there is one party who does work in violation of the rules that have been determined, it must be responsible for acts against the law.
