Abstract
This research is limited to parental neglect by children by neglecting within the scope of the household. This study aims to explain parental neglect by children from the point of view of criminal and Islamic law, to know the law enforcement policies against the criminal acts of neglect of parents by children at the Magetan Police and to know the role of the Tresna Werdha Magetan Social Service Technical Implementation Unit in dealing with victims of parental neglect. This research is a descriptive study using a normative-empirical approach and data validity testing techniques using data triangulation and data analysis techniques, namely qualitative analysis. The results of the study show that the criminal law policy related to parental neglect is regulated in a special law, namely Law Number 23 of 2004 concerning the Elimination of Domestic Violence. Neglect of parents by children in Islamic law whose discussion is limited to jinayah or Islamic crimes, including Jarimah ta'zir based on the story of alaqamah in the time of the prophet Muhammad SAW. Law enforcement against the criminal act of neglect of parents by children carried out by Magetan Police Investigators is not in accordance with the applicable laws and regulations because. The role of UPT PSTW Magetan in dealing with victims of neglect in the household, especially the elderly, is in accordance with applicable laws and regulations.
