Abstract

Apostasy is the expulsion of a person who adheres to the Islamic religion or his conversion from Islam to another religion. If there is an Islamic marriage relationship between a husband and wife, their marriage relationship is broken as a result of apostasy. By changing religions, of course, there are some differences in understanding that lead to disharmony in the household, from this disharmony that causes the breakup of marital relations. The principle of Islamic personality is a principle inherent in the religious judiciary which is aimed at Muslim people, meaning that only people who are Muslim can have litigation in the religious court environment. The Religious Courts have the task of receiving, examining, adjudicating, and resolving Muslim cases with the aim of enforcing the law and providing justice based on the Qur'an, al-Hadith and ijtihad. This article belongs to the type of normative research. Normative legal research is a step to find a rule of law, legal principles, and legal doctrines in order to answer the legal issues faced. The approach method used in the preparation of this article is normative juridical research
