Abstract

E-commerce not only makes it easy for consumers, but this development makes it easier for producers to market their products. But in reality, when buying goods online there is no guarantee of product quality. Reviews are not always reliable and all leads are not necessarily convincing, sellers sometimes deliberately mislead consumers in order to increase sales online. So that in some cases there is often a mismatch related to the goods ordered by the consumer due to bad faith from the online seller, or bad faith on the part of the consumer by canceling orders which cause losses from the online party. The approach method used in this research is a juridical empirical approach. This type of research is descriptive. Types of data used are primary data and secondary data consisting of primary legal materials and secondary legal materials. Methods of data collection using field study methods by conducting interviews and observations. The data analysis method used in this research is deductive analysis method. Respondents in this study were several sellers and buyers who made buying and selling transactions through the Shopee application. This research was reviewed based on the principles of good faith and engagement law relating to legal protection for parties in the Shopee application. The results of this research indicate that there are still many cases that injure the principles of good faith and legal agreements when the parties are buying and selling using the Shopee application. For example, the frequent occurrence of defaults and fraud of Shopeepay accounts.
