Abstract

Defamation throught technolgical sophistication in the form of software or better known as defamation throught social media. This crime can also be incorporated into cyber crimes. It is regulated in article 27 paragraph 3 of law number 11 of 2008 concerning information and electronic transactions and in the criminal code. In the determination of decisions related to defamation throught social media must meet the element in the case of defamation on social media. So the judge in deciding the case number 6/Pid.Sus/2017/PN.Slr and case number 232/Pid.B/2010/PN.Kdl must be fulfill these element.
