Abstract

ABSTRACT Sharia Financial Institution (LKS) is one of the sectors of Islamic economy that developed rapidly in the last few decades. This rapid development is not only driven by the worsening of the world's money economy system driven by the conventional system, but also by the religious spirit and pragmatic practical interests in developing the people's economy. Along with the development of LKS at this time of course can not be separated from the problems, one of them about the rules that regulate the LKS. There are two rules governing LKS namely the Financial Services Authority Regulation (POJK) and the Compilation of Islamic Economic Law (KHES). The formulation of this research problem discusses how the flow chart in the religious court, how the role of KHES against material law in the settlement of sharia economic dispute in the religious court, and how to settle if there is a difference of perception between POJK and KHES to dispute sharia economy that enter in religious court. This type of research is a type of juridical legal research empirical and using a qualitative method approach. The location of this research is in Boyolali Religious Court.
