Abstract
An orphanage is a social welfare institution that has the responsibility of providing substitute services, in caring for, nurturing and educating children, so that these children's rights are fulfilled in terms of their physical and mental needs and provision of them with various skills. In child care at an orphanage, an agreement is made by both parties, namely parents or guardians with the orphanage. This is done to avoid problems in the future and also to guarantee the rights and obligations of both parties. In this study the authors conducted research on the legal responsibility agreement in the agreement on handing over child custody rights to the Nur Hidayah Surakarta orphanage. This study aims to determine the validity of the agreement between the orphanage and the parents or guardians. And to find out legal responsibilities between parents or guardians who make agreements. The method used by the author is in legal research used in the research conducted is the elaboration of normative and empirical (mixed) legal research. This research was conducted by examining primary data obtained from the field/environmental field as well as secondary data from the library to find out whether the agreement to surrender the child to the orphanage at the Nur Hidayah Foundation fulfills the validity of the agreement in Article 1320 of the Civil Code. The results of this study indicate that the agreement on handing over child custody rights to the Nur Hidayah Surakarta orphanage between the orphanage and the parents, if viewed from the validity of the agreement, has fulfilled the legal elements and for legal accountability if there is a violation of the agreement, foster children are returned to parent or guardian of the child and the agreement is terminated. However, the legal liability of the orphanage is not regulated in the agreement.
