Abstract

With the existence of transsexuals based on the results of the decision from the Surakarta City District Court, this made researchers conduct research related to transsexual heirs according to the views of figures in Nahdlatul Ulama (NU) Islamic organization. This is because this organization is one of the organizations that upholds the value of moderation in Islamic teachings also because the legal regulations regarding transsexual heirs here have not been regulated in positive law in Indonesia. The purpose of this research is to find out about the legal status of gender and the division of inheritance for transsexual heirs in Surakarta City. This makes this research carried out using the phenomenological approach method with the type of empirical juridical research, then the source of the study comes from the literature and the field which will be analyzed descriptively. The transsexual gender status of transsexual heirs according to NU figures in Surakarta City is still returned to the original sex at birth both before and after receiving a decision from the local district court. Therefore, regarding the division of inheritance for transsexual heirs, in this case, it is adjusted to Islamic inheritance law based on the initial sex of transsexual heirs before carrying out genital change medical operations.
