Abstract
Brand is one of the strategies of companies that produce goods or services to advance and develop their business. By using a brand, an item or service has an identity. In Indonesia, trademark infringement often occurs. Similar brands, for example, Oreo and Goriorio, GOTO and goto, Pierre Cardin (France) and Pierre Cardin (Indonesia), IKEA and iKea, and many other cases. As happened to the HUGO BOSS brand, which has suffered losses due to trademark infringement due to bad faith on the registration of the same mark in principle or in its entirety. The problems discussed are regarding the form of legal protection for well-known foreign trademark holders in Indonesia and how legal remedies can be taken by well-known foreign trademark holders in Indonesia in the event of a trademark infringement. In writing this thesis, the author used normative legal research methods. The research was descriptive. The author used Primary and Secondary data in writing this thesis. From the research results obtained in Indonesia, it had provided protection to brand holders in the form of preventive and repressive protection. Trademark holders can also take legal action through the courts in the form of lawsuits and cassation.
