Abstract

The object of the credit agreement related to legal responsibility is related to the provision of money or bills based on a loan agreement which requires the debtor to pay off his debt, if the debtor does not fulfill his obligations to the Guyub Artha Jaya Delanggu KSP then it is classified as an act of default. Furthermore, the purpose of this study is to determine the form and content of the credit agreement and legal responsibility if the debtor defaults on the credit agreement with KSP Guyub Artha Jaya Delanggu. So the problem is examined by normative or doctrinal methods, using descriptive analysis and sources of library research from secondary legal materials. The form of credit agreement at KSP Guyub Artha Jaya Delanggu consists of an agreement made under the hand, attended by a notary witness and before a notary (deed). The financing of the procurement of consumer goods uses installment payments wherein submitting guarantees so that the credit agreement runs smoothly according to the Civil Code, namely Article 1313, Article 1319, Article 1754, Article 1320, Article 1338, as well as the principles of freedom of contract, consensualism, pacta sunt servanda, and good faith. If the debtor defaults, legal responsibility is required in the form of fines, compensation, or filing a lawsuit to the district court.
