Abstract

The rapid development of the times in Indonesia, inevitably causes many aspects of life to develop, for example in terms of the utilization of electricity. Electricity is needed today, because many of the necessities of life are sourced from the electricity. Utilization of electric power, is basically a matter in which there is an agreement between PLN and consumers. This research basically aims to find out how the agreement process that occurs between PT. PLN with customers, related regulations and the rights and obligations of each party, and also later to find out the legal responsibilities in the electricity utilization agreement between PT. PLN with consumers. The approach method used in this research is a normative legal approach method, where this research which is examined by the author is the law or rules related to the Legal Responsibility of PT. PLN (Persero) with Consumers in the Context of Utilizing Electrical Energy. Then the type of research used in this research is descriptive, where the intention is to explain and systematically analyze related legal responsibilities between PT. PLN with consumers in the context of utilizing electricity. The result of this research is that the process of agreement on the use of electricity between PT. PLN with consumers is carried out in three stages, namely before an agreement occurs, while an agreement occurs and after an agreement occurs. Also between PT. PLN with consumers or customers must meet the administrative requirements and legal requirements that are known by each party. Regarding the agreement, then it can happen if between PT. PLN with consumers or customers agree to enter into an agreement for the use of electricity and then produce a Power Purchase Agreement (SPJBTL). Furthermore, a legal relationship arose between PT. PLN with consumers, regarding the rights and obligations that each party has and must respect, the implementation of which must not violate applicable regulations. If one of the parties does not carry out their obligations properly, they are obliged to be responsible on the basis of default according to Article 1243 of the Civil Code and if one of the parties violates the laws and regulations, public order and morality related to the agreement on the use of electricity, it can be said to have committed an act against the law and required to be responsible under article 1365 of the Civil Code. So if all of this is proven, then he must make compensation to the injured party according to the applicable regulations.
