Abstract

The lease agreement is an agreement, namely that one party provides enjoyment of an item to another party for a certain time, as well as payments that have been agreed by that party. The agreement can be in written or oral form. In the agreement there must be an object that is the subject of the birth of the agreement, in this case, the object is land. The author found a form of land lease agreement in written form at PT. Anugerah Nusantara Gas Lampung. The agreement creates a legal relationship between the parties, namely the existence of rights and obligations that must be fulfilled by both parties. The approach method used in this research is juridical-normative, with a descriptive type of research. The results of the research and discussion show that, 1) The form and content of the land lease agreement of PT. Anugerah Nusantara Gas Lampung is made authentically, and complies with Articles 1313, 1320, 1548, 1868 of the Civil Code, besides that it is in accordance with the principles of freedom of contract and the principle of consensualism, and fulfills the essential, natural, and accidental elements. 2) The legal relationship of the land lease agreement of PT. Nusantara Gas Award. The legal relationship occurs after the agreement is legally made and signed by both parties. Based on Article 1338 paragraph (1, 2, 3) of the Civil Code. And in accordance with Article 1550 paragraphs (1, 2, 3) and 1560 of the Civil Code.
