Abstract

Abstract The making of the deed of establishment of CV. Hidayahku involves two parties including the client and the notary, so it is called a reciprocal agreement and therefore creates rights and obligations between the client and the notary. If in carrying out the rights and obligations of one of the parties does not fulfill the performance, then legal responsibility arises. The purpose of this study was to determine the implementation process of making the deed of establishment of CV. Hidayahku, the rules and rights and obligations between a notary and the client, and legal responsibility for defaults or acts against the law. This study uses a normative approach, namely by examining legal rules and legal principles relating to the responsibilities of the notary and the client in making the deed of establishment of CV. Hidayahku. The type of research used in this research is descriptive research by clearly describing the date of legal responsibility between the notary and the client in making the deed of establishment of CV. Hidayahku. The results of this study indicate that in the process of implementing the agreement to make a deed of incorporation, the CV includes: (1) Before the notary agreement and the client must meet administrative and legal requirements, (2) when the agreement occurs, which is marked by an agreement to make a deed of establishment CV which has been by a notary based on a standard agreement, (3) After an agreement occurs, a legal relationship arises 2 in the form of rights and obligations that bind the parties and in carrying out the rights and obligations both parties must comply with the regulations in the applicable deed of establishment. If the obligation is not fulfilled, it can be accounted for based on default, while if one of the parties violates it can be required on the basis of being against the law.
