Abstract

An outsourcing work agreement is an agreement between a contracting company or a service provider company for workers/laborers and workers/laborers in a contracting company or a worker/labor service provider company that contains the rights and obligations of each party. The purpose of this study is to determine the process of implementing an outsourcing work agreement between service providers, service users and with workers in carrying out work with a contract system, regulations and rights and obligations of the parties after the outsourcing work agreement and legal responsibilities for the parties in the event of default and Act against the law. The research method is a normative approach by researching legal principles, legal norms and legal responsibilities regarding outsourcing work agreements with a descriptive analytical nature of research which will explain thoroughly and systematically about the implementation of outsourcing work agreements between service providers, service users and with workers in doing work with a contract system. Sources of data in this study is to use library research to find secondary data and field research to obtain primary data. The results of the study show that the outsourcing work agreement can be implemented if the parties have fulfilled the administrative and legal requirements, then the parties make a letter of agreement. The agreement is made in writing, the agreement was born because of the agreement of both parties and the signing of an outsourcing work agreement between the parties. After the agreement, a legal relationship arises which gives birth to the rights and obligations of each party that must be implemented. Legal liability arises because of an error made by one of the parties to the agreement. The error can be based on default and unlawful acts.
