Abstract

Law Number 8 of 1999 concerning Consumer Protection established an institution in consumer protection law, namely the Consumer Dispute Settlement Agency. Article 1 point 11 of the UUPK states that "The Consumer Dispute Settlement Agency (BPSK) is the agency tasked with handling and resolving disputes between business actors and consumers". This study aims to find out how the legal considerations of the BPSK Arbitrator in examining and deciding the case Number: 01/Abs/BPSK-Yk/V/2019 concerning Forced Motorcycle Withdrawals. This research uses a doctrinal approach. Using this type of descriptive research. The results of the study indicate that the legal considerations of the Judge of the Consumer Dispute Settlement Agency Number: 01/Abs/BPSK-Yk/V/2019 regarding the forcible withdrawal of motorbikes carried out by Business Actors are in accordance with Article 18 paragraph (1) letter (f), Article 19 paragraph (2), Article 52 letter (a), Article 52 letter (f) and Article 52 letter (g) of the Consumer Protection Act and also in accordance with the doctrine or opinion expressed by Salim HS, Mr. J. H. Nieuwenhuis as translated by Djasadin Saragih, Subekti, Amriani and Wirjono Prodjodikoro.
