Abstract

Ihsan Burhany. I000160016. Analysis of Islamic Law Against Franchise (Beverage) Business Concepts with Musyarakah Contracts, Case Study in Karanganyar Regency. This study describes the franchise business concept in terms of the perspective of the Musyarakah contract contained in the Senyumsapa beverage franchise business according to Islamic law. The purpose of this study is to find out how the franchise business concept and the application of the Musyarakah contract in the Senyumsapa business are reviewed according to Islamic law. The research method used is qualitative with the type of field research (field research) taken by means of interviews with the owner or owner of the Senyumsapa, documentation on the object under study. The results of the study explain that the franchise business system does not conflict with Islamic law with a note that the object used does not violate Islamic Sharia, and the franchise adopted by Senyumsapa is a business format franchise or business format franchise where the franchisor grants rights to the brand, logo, and system used. available to the franchisee with the type of musyarakah contract. Musyarakah means an investment transaction from two or more owners of funds or goods to run a certain business in accordance with sharia with the distribution of operating results between the two parties based on an agreed ratio, while the distribution of losses is based on the proportion of their respective capital. The profit sharing in this Senyumsapa business is 40% for Siti as the franchisor and 60% for Ima as the franchisee. The business processes contained in the Senyumsapa franchise are in accordance with the rules in Islamic law.
