Abstract

This study aims to determine the causal factors and legal considerations made by the judge in deciding the transfer of marriage guardianship. The research method uses normative legal research or descriptive doctrinal research. The data analysis method uses this model qualitatively, a way that uses deductive logic, namely by drawing conclusions from a general problem into a specific or individual problem arranged in regular, coherent and effective words or sentences to facilitate understanding of the results of data analysis. research. Based on the results of the research, it was concluded that the factor for submitting the petition for wali 'adhal was caused by the subjective reasons of the respondent as the petitioner's biological father and the judgment of the panel of judges in determining the case of guardian' Adhal in accordance with legal principles, both positive law and Islamic law.
