Abstract

The objectives of this study are: (1) To find out and provide a general explanation of the form of the agreement for the transportation of goods by air at PT. Suryagita Nusaraya Cargo; (2) To find out as well as provide a general explanation regarding the implementation of the transportation of goods by air at PT. Suryagita Nusaraya Cargo; (3) To find out the responsibility of PT. Suryagita Nusaraya Cargo to consumers in an agreement to transport goods by air. This research method uses empirical juridical research methods, namely an approach by looking at a legal reality in society. This research was conducted at the PT. Suryagita Nusaraya Cargo in Surakarta with data analysis techniques using qualitative analysis. The results showed: (1) The form of agreement for the transportation of goods by air transportation at PT. Suryagita Nusaraya Cargo fulfills the legal requirements of the agreement in Article 1320 of the Civil Code; a) Agree Those Who Bind Themselves; b) Proficiency, PT. Suryagita Nusaraya is a legal entity that has met the terms and conditions for the establishment of a PT where the founders must be adults based on data in the form of identity. Likewise with the sender, they must attach their identity in the form of a photocopy or fill out a form; (2) The procedures for sending goods include the following: a) Packing of the Shipment; b) Checking the Shipment; c) Delivery of the Shipment; d) Checking the Goods at the Delivery Location; (3) Disputes arising as a result of the implementation of this agreement will be resolved by deliberation and consensus between the Parties and if the dispute cannot be resolved properly, the Parties agree to select and settle at a permanent legal position at the District Court.
