Abstract

The key issue of this study is sale and purchase as one of the economic activities that are allowed under Islamic law. One example of sale and purchase practices in Bacem Village is the sale and purchase of rice agricultural products using a wholesale system. In this system, the buyer only estimates the rice in the fields without weighing them. Therefore, there is a possibility of gharar and not meet the principle and requirement of sale and purchase under Islamic law. This study aim s to determine the sale and purchase process of rice agricultural products using a wholesale system and to review the Islamic law related to the sale and purchase of rice agricultural products using a wholesale system in Bacem Village. This study used a qualitative method and it used descriptive data obtained through interviews and documentation of the rice sellers and buyers who use the wholesale system in Bacem Village. Then, the data were analyzed to identify the sale and purchase practices of rice agricultural products using a wholesale system in Bacem Village based on Islamic law. The results indicate that based on Islamic law, the sale and purchase practice of rice agricultural products using the wholesale system practiced by some communities in Bacem Village is not legal. It is because one of the sale and purchase requirements is not fulfilled, even though all principles of sale and purchase have been fulfilled. This practice contains gharar as the results obtained do not match the initial estimates of the transaction.
