Abstract
This research aims to analyze the non-fluently loan installment payments between Hotel Sahid Jaya Solo, which represents its employees with BPR Bank Solo due to the Covid-19 pandemic. The purpose of this research is to find out how the implementation of the credit agreement between Hotel Sahid Jaya Solo and BPR Bank Solo during the Covid-19 pandemic. And what the solutions are taken if problems occur in the implementation of agreement. The method used in this research is an empirical juridical approach. For the results of the research obtained the credit agreement between Hotel Sahid Jaya Solo and BPR Bank Solo based on the Cooperation Agreement for Providing Credit Facilities between Hotel Sahid Jaya Solo and PD. BPR Bank Solo which has met the matters, and the terms of the agreement in accordance with Article 1320 Civil Code or "KUHPerdata". The implementation of this agreement has been affected since the Covid-19 pandemic, this is because of the Sahid Jaya Solo Hotel lost income. The employees did not receive a full salary so they could not be paid to the BPR Bank Solo as payment for credit installments. This situation is included in the category of overmacht or a state of force. Therefore, Hotel Sahid Jaya Solo asked for relaxation from BPR Bank Solo in the form of an agreement to exempt hotel employees from paying credit installments for three months and starting from the fourth month it was agreed that credit installments continued, which meant that they were still paid with makeshift of money. How much money of a hotel employee has, it was used to be paid for the credit installments at BPR Bank Solo.
