Abstract

The objectives of this study are: a) to determine the legal status of interfaith marriage according to positive law and Islamic law; b) To find out the consequences of the rights and obligations of interfaith marriage. The approach method used in this research is the normative method. This type of research is descriptive. The results obtained are that the analysis conducted by the author of the Determination Number: 421 / Pdt. P / 2013 / PN. Ska is based on the Decision of the Constitutional Court (MK) Number 68 / PUU-XII / 2014 rejecting the review of Article 2 paragraph (1) of Law No. 1 of 1974 concerning Marriage which states: "Marriage is legal if it is carried out according to the law of each religion and belief". The petitioner for this case feels that his constitutional rights have the potential to be harmed by the enactment of the legal requirements of marriage based on religious law. The Petitioner is of the opinion that the regulation of this article will have implications for the invalidity of marriages conducted outside the law of their respective religions and beliefs, for example interfaith marriages support the Decision Number: 421 / Pdt. P / 2013 / PN. Ska. Marriage between a Muslim man and a Muslim woman is haram. This is based on the word of Allah SWT in al-Baqarah Verse 221. MUI Fatwa Decree Number: 4 / MUNASVII / MUI / 8/2005 which was stipulated on July 29, 2005 in conjunction with the VII MUI National Deliberation in 2005. This general opinion was later adopted and followed by the Compilation of Islamic Law in Indonesia. This fatwa was formed based on the Qur'anic letter. al-Nisa [4]: 3); Al-Rum [3]: 21); Al-Tahrim [66]: 6); Al-Maidah [5]: 5); Al-Baqarah [2]: 221Al-Mumtahianah [60]: 10); Al-Nisa [4]: 25), Hadith narrated by muttafaq alaih from Abi Hurairah r. a and Fiqh Rules: "Preventing obedience takes precedence (takes precedence) than attracting benefit".
