Abstract

The violence these days is not only used by adult but also youngsters. A minor child as a youngster who commited this kind of action can be defined as commited juvenile delinquency. The definition of minor child as the writer refers in the begining is the one who has been reached the age of 12 but has not reached yet, based on Article 1 verse (3) in Childern’s Criminal Justice System of Law No. 11 Year 2012. Juvenile delinquency itself is an act of a minor child which violating the law or commiting a crime. The sentences of a crime that commited by an adult is certainly cannot be applied to a minor child even the action has the same kind of qualifications. The reason behind differentiated of the sentencing towards a minor child is the main purpose of Childern’s Criminal Justice System to bring the equality and deprivation of freedom as the last option can be done against them (ultimum remidium). The aim of this research is to exploring the reason behind deprivation of freedom sentence can be applied to the minor child.
