Abstract

Trading transactions in Indonesia are experiencing a very rapid development, in payments especially non-cash that still required indonesians to make payment transactions in national economic activities are bilyet giro, bilyet giro that is empty often occurs in payment traffic where it is an unlawful act that can cause losses for the parties who are entitled to payment from the giro bilyet. In the analysis of the dispute resolution process of conduct against the law of purchasing material with empty giro bilyet as a means of payment in the district court, then this research aims to know the process of buying and selling conducted by using empty giro bilyet so that there is a case of unlawful conduct, to know the consideration of the judge in determining the evidence of the act against the law of purchasing material with empty giro bilyet as a means of payment and to know the judge's consideration in determining the verdict against the law of the purchase of material with bilyet giro empty as a means of payment and to know the consideration of the judge in determining the decision of action against the law of the purchase of material with empty giro bilyet as a means of payment and to know the consideration of the judge in determining the judgment of the action against the law of purchase of material with empty giro bilyet as a means of payment and to know the consideration of the judge in determining the case against the law of purchase of material with empty giro bilyet as a means of payment and to know the consideration of the judge in determining the case against the law of purchase of material with empty giro bilyet as a means of payment and to know the consideration of the judge in determining the case against the law of bilyet giro is empty as a means of payment. This research uses a normative approach, because what will be examined are the rules of law, legal principles related to the dispute resolution process of action against the law of purchasing material with empty giro bilyet as a means of payment. This type of descriptive research is due to analyze and decipher the dispute resolution process of action against the law of purchasing material with empty giro bilyet as a means of payment in the District Court. The results showed that the Tribunal of Judges concluded that defendants had committed unlawful acts by making payments using empty giro bilyets. Based on article 1365 of the Civil Code, The Defendant committed an unlawful act then the Panel of Judges stated in its ruling that granting plaintiff's claim for a portion, that the Defendant did not fulfil his obligation to pay material damages of Rp.469,248,000,- (four hundred and sixty-nine million two hundred and forty-eight thousand rupiah) to the Plaintiff. As a result of the law after the case against the law the payment of empty giro bilyet has been decided by the judge, namely the Defendant as the losing party must carry out the judge's ruling and pay the costs of the case which to this day is set at Rp. 1,316,000,- (one million three hundred sixteen thousand rupiah).
