Abstract

Islam requires commerce to userepresentatives because humans need them, which are then called brokers. Brokerage practices are permitted in Islam if the implementation does not contain an element of deception. Many people in Pacitan carry out brokerage transactions, especially for buying and selling used motorbikes. The main problems in this research are: first, how is the brokerage practice for buying and selling used motorbikes in Pacitan Regency, second, how is the Islamic law reviewing the way on brokerage practices for buying and selling used motorbikes in Pacitan. The purpose of this research is to determine the process of the brokerage practice for buying and selling used motorbikes in Pacitan District and to find out the suitability of the brokerage practice for buying and selling used 2 motorbikes in Pacitan with Islamic law. The method used in this research is a qualitative descriptive, namely conducting interviews with respondents in order to obtain data orally and in writing to determine the phenomena of used motorbikes brokerage practices in Pacitan. This study uses a normative and sociological approach, which is to approach the problem under study by looking at the benefits and harms of used motorbikes brokerage practices in Pacitan, which is reviewed using the theory of muamalah fiqh. The results of this study indicate that most of used motorbikes brokerage practices in Pacitan use oral contracts and the rest use written contracts. An oral contract is carried out because in general the buyer and seller have mutual trust in the broker. The additional price made by brokers is something that most sellers and buyers know. The profit earned by the broker varies depending on the year the motor is produced, the brand, and the condition of the motorbike but on average is as much as Rp. 500,000.00. The profits earned by the broker are still within reasonable limits and the price offered is still in accordance with the market. The law in the brokerage practice of used motorbikes in Pacitan is valid according to the syari'at because it comply with the pillars and requirements in muamalah fiqh.
