Abstract

Geographical indication is a sign indicating the area of origin of a good and / or product which due to geographical environmental factors including natural factors, human factors or a combination of these two factors gives certain reputation, quality and characteristics to the goods and / or products produced. One of the intellectual property that can be requested for protection of geographical indication is batik. However, there are still many batik that has no geographical indication protection, even though it has the potential, one of which is the Magetan Pring Sedapur Batik. Therefore, the purpose of this study is to determine the legal protection efforts of geographical indications and the factors that carry out the registration of the Pring Sedapur Batik Geographical Indication, Sidomukti Village. This type of research used in this research is descriptive research with an empirical juridical approach method. The results showed that the new Pring Sedapur batik had copyright protection, it did not yet have the protection of its geographical indication. Even though Pring Sedapur batik has a distinctive pattern that symbolizes Magetan such as bamboo, starling lawu and other typical Magetan plants. This of course meets the requirements of the geographical indication itself. The inhibiting factors are the lack of knowledge of the craftsmen and the absence of encouragement from the local government to register the Pring Sedapur batik under the protection of Geographical Indications.
