Abstract

Transportation is a means of transportation that is mostly used to support human activity in carrying passengers or even transporting goods. There are three kinds of transportation, one of them is land transportation. Land transportation especially bus is public transportation that is used by humans to travel to other cities and provinces. Tour bus is a special bus that is leased by a tenant for tourism activities. Therefore, this research has some purposes which are: to know the process of leasing agreement between Epic Tour and Travel by the passengers, the parties’ rights and obligation and the regulations that apply in this rental as well as the legal responsibility if one of the parties do mistakes in the implementation of the tour bus rental agreement. The approach of this research is the normative approach because this research is researching the legal aspect related to the tour bus rental agreement. This research is descriptive research that explains whole things about legal responsibility toward the tour bus rental agreement. The result of this research shows that there are three steps of the tour bus rental process that are before the agreement, during the agreement, and after the agreement. Before the agreement is held, the tenant has to complete all regulations and also the administration and law terms. The renter and the tenant must sign the MoU that contains the terms agreed upon beforehand. When both sides have signed the MoU so there is an agreement between them. The agreement will cause legal relation and brings rights and obligations on each party. The renter’s rights are the tenant’s obligations, while the tenant’s rights are the renter’s obligations. Therefore, both parties must comply with the applicable regulations in the rental agreement, if the one party does not comply there will be a legal responsibility. The legal responsibility occurs when one of the parties makes a mistake, an error based on a default in Article 1243 of the Civil Code (KUHPer) and mistakes for acts against the law in Article 1365 of the Civil Code (KUHPer).
