Abstract

In principle, the dispute resolution process is divided into two channels, namely the court (litigation) and the path outside the court (non-litigation) which is often referred to as alternative dispute resolution / ADR (Alternative Dispute Resolution). BASYARNAS (National Sharia Arbitration Board) as an Islamic arbitration institution that handles the resolution of Islamic economic disputes based on Islamic law with sharia principles. With Basyarnas, it can be an alternative for sharia economic entrepreneurs to resolve their disputes quickly, efficiently, flexibly and at a low cost if no agreement is reached through consultation. But besides the advantages through the arbitration process there are also still shortcomings that can be obstacles that occur in the process of settling the dispute. The purpose of this study is to find out how the processes and constraints that occur as well as the effectiveness and existence in the resolution of Islamic economic disputes through Basyarnas. The research method used in this study is juridical research, with descriptive qualitative analysis.
