Abstract

This type of research is field research using a descriptive qualitative method that is research aimed at knowing and analyzing the process of buying and selling fruit that has been damaged in Kadipolo Market and analysis in the perspective of Islamic law related to the process of buying and selling fruit that has been damaged in Kadipolo Market In this study, researchers directly examined and conducted interviews with the Kadipolo Market Management Office and the sellers and buyers of damaged fruit in the Kadipolo Market related to factors that led to the process of buying and selling damaged fruit and the provisions in Islamic law governing fruit trading the damaged. Based on research and data analysis, it can be concluded that the buying and selling process of damaged fruit at Kadipolo Market violates some of the applicable legal provisions in Islam. It is haram if the damaged fruit is consumed by the buyer, because it can cause harm to the buyer and it is not haram if the damaged fruit is used as animal feed. Islam prohibits the sale of damaged fruit because it does not meet clean or holy requirements, namely goods that are traded are not unclean, can be used, goods or objects that are traded belong to people who do it themselves, goods or objects that are traded can be handed over, goods or objects that are sold Buying can be known and goods or goods 2 that are traded and traded may not be returned ”. By not fulfilling one of the legal requirements for the object of sale and purchase, in this case the damaged fruit can result in losses for the party buying it, because it can be detrimental from the health side. By consuming damaged fruit, even though the damaged part has been removed, it is possible that bacteria will still stick to the undamaged part of the fruit that is consumed.
