Abstract
PT. Surya Andalan Primatama is a company engaged in the processing of palm oil that uses the RSPO standard (Roundtable on Sustainable Palm Oil), namely waste management that is carried out well so it does not pollute the environment. This study aims to determine the implementation of the freelance work agreement at PT. Surya Andalan Primatama is reviewed based on Law no. 13 of 2003 concerning manpower and know the legal responsibilities of the parties in terms of defaults and unlawful actions in freelance work agreements. This research uses a normative juridical approach. This type of research is descriptive qualitative. The results showed that the freelance work agreement at PT. Surya Andalan Primatama contains work provisions that contain the rights and obligations of the parties including work contracts, wages and benefits, division of work time and attendance in accordance with the provisions of the Manpower Act. However, in the implementation of freelance work agreements, there are defaults and unlawful actions committed by employees. Legal liability for breach of contract and unlawful acts that occur in the implementation of a freelance work agreement, PT. Surya Andalan Primatama made a settlement effort through bipartite and mediation by providing a communication forum for deliberation for problem employees and facilitating it by providing mediators assigned to unite the interests of the two disputing parties. Management of PT. Surya Andalan Primatama held a dialogue and meeting with union officials to discuss and resolve problems that arise in the company.
