Abstract

Basically, buying and selling transactions electronically (online) is almost the same as conventional transactions, only the difference is the medium used. In the Electronic transactions (online) The parties do not meet directly so that the agreement occurs through the Internet. The downside of this transaction is that there is no provision on the age restriction for parties who enter into an online sale of purchase. The purpose of this research is to know the views and consequences of the law incurred in an electronic (online) Buy and sell transaction when the person or one of the parties is a minor. The method of study used was the juridical approach method in which the data collection process was conducted by interviewing some minors and analyzed. The results of this research obtained that when associated with the law of Agreement then the provisions in the sale and purchase online must be subject to the KUH Perdata if the parties are not legally capable then the agreement can be cancelled. But until now there have been no rules governing the specific age of a child is allowed to buy and sell online. Therefore, online buy and sell transactions can still be said to be legitimate as long as the goods traded are not so important. But if later arises a problem then the legal force of the Treaty is weak because it does not meet the conditions of the agreement in article 1320 KUH Perdata. While regarding the legal remedies that can be pursued in online shopping disputes pursuant to Article 38 paragraphs (2) and article 39 paragraphs (1) of the Electronic Information and transaction Act through two lines of litigation, through courts and Non-litigation, that is through the process of negotiation, mediation, conciliation, and arbitration.
