Abstract

Research on the review of Islamic law on adoption of children whose parents are not known, aims as follows: a) To find out the concepts of Islamic law and positive law in Indonesia regarding adoption of children whose parents do not know; b) To find out the judge's considerations in deciding the appointment status of children whose parents do not know; c) To find out the solution to the problem of adoption of children whose parents do not know. The method used in this research is the normative method. This type of research is descriptive. The research results obtained that the concept of Islamic law and positive regarding the arrangement of adoption of children is regulated in Article 1 paragraph (1) Government Regulation No. 54 of 2007 concerning the implementation of adoption of children. The evidence used by the MUI Fatwa regarding the adoption of children includes: a) Al- Quran Surat Al-Ahzab verse 4, Surat Al-Ahzab verse 5, Al-Ahzab verse 40; b) The words of the Prophet Muhammad. Judge's consideration in deciding the appointment status of a child whose parents do not know where the District Court has read the petition letter of the applicant dated November 28, the Petitioner is not serious about the Petition. The judge in his determination stated; a) Declare the petition of the Applicant to Fall; b) Imposes the petitioner to pay the court fee incurred in this case amounting to Rp. 161,000 (one hundred and sixty one thousand rupiah). Settlement of problems regarding adoption of unknown parents whose judge uses ex officio's right to refuse. In ex officio legal dictionary means because of the position.
