Abstract

This study aims to determine the juridical analysis of the Home Ownership Credit (KPR) agreement such as the form and content of the Home Ownership Credit (KPR) agreement at Bank BTN, legal liability to the parties in the Home Ownership Credit Agreement (KPR), and to find out the problems problems that arise in the KPR and solutions to resolve the problems faced by Bank BTN. To achieve these objectives empirical legal research has been carried out, the nature of descriptive research, the data sources used are primary data and secondary data which includes primary legal materials, secondary legal materials, data collection techniques using qualitative data analysis. The results of the study found that based on research the form and content of the mortgage agreement (KPR) has been determined by the Bank as Undang-Undang Nomor 10 Tahun 1998 Tentang Perbankan. Legal liability to the parties in the Home Loan Agreement (KPR), the Bank has the responsibility to provide funds to the debtor in accordance with the value agreed by the Bank. The funds will be used to buy a house by way of credit and the debtor has a responsibility to the Bank to pay installments every month in accordance with what was agreed upon until the full payment. While the problems faced in the Home Ownership Credit agreement are debtors who do not fulfill their obligations to pay, and if the debtor does not fulfill his responsibilities and does not have good faith, the Bank will take the court or be sold to someone else.
