Abstract

In the current era of industrialization, credit is not far from everyday life. For the community, both able and disadvantaged people, credit is a solution to meet the needs of people's lives such as clothing, food, shelter. One important credit principle is Guarantee. In the credit activities that occur in the community, it can be noted that in general it is often required to surrender credit guarantees. Credit guarantees will have several functions and one of them is to secure credit repayment if the Debtor fails to promise. Credit guarantees have an important role in securing bank refunds. Land is one of the immovable objects which is widely used as collateral for the repayment of credit. Guaranteed mortgage rights are often used to obtain credit facilities because the land has a high economic value and always increases over time. Land rights as collateral in the agreement between the creditor and the debtor can be bound by using the Mortgage. The role and function of the notary / PPAT is important in helping the government and other parties who need it to provide certainty, order and legal protection in making an authentic deed and registration of Mortgage Rights until a certificate is issued by the Land Agency.
