Abstract

Education of persons with disabilities is a right that has gained recognition both in international and national regulations. Recognition of the right to education is contained in article 26 of the Universal Declaration of Human Rights, in article 13 recognizing basic education must be provided to everyone for free. International Covenant on Economic, Social, and Cultural Rights (1966) which has been ratified by Law No. 11 of 2005 which recognizes education as a human right. The 1945 Constitution of the Republic of Indonesia which determines that education is a basic right of citizens. This is contained in Article 28 C paragraph (1) and Article 28 E paragraph (1) of the 1945 Constitution of the Republic of Indonesia. Specifically in the international regulation on persons with disabilities is the Convention on the Rights of People with Disabilities with Resolution 61/106 which was later ratified with Law Number 19 of 2011. And the right to education is regulated in article 24. The right to education has also been regulated in Law Number 39 of 1999 concerning Human Rights especially Article 12. Specifically the protection of the rights of persons with disabilities including the right to education is contained in Law Number 8 of 2016 concerning Persons with Disabilities. With this education guarantee, people with disabilities have broad avenues in increasing their ability to adapt to technology and to get a better standard of life. The implementation of the law is basically the local government through the Social Service and Extraordinary Schools trying to fulfill the rights of persons with disabilities especially in education.
