Abstract

In this increasingly sophisticated modern era, human needs for electronic devices are increasing rapidly. One of them is the camera, the camera is one of the belle of the community because of its benefits in taking pictures in every precious moment that might not happen a second time. But the price of the camera is fairly expensive causing people to be reluctant to buy it. This situation is used by some people to open up camera rental business opportunities, this business also makes it easier for people who want to use a camera without the need to pay a large fee to buy a camera. The development of tourist destinations in Boyolali also had the effect of developing a camera rental business in the region. Therefore, this study aims to determine the process of the camera rental agreement in Boyolali between the parties, the rights and obligations between the parties, as well as legal liability if one party violates or makes a mistake on the basis of Default or Unlawful Acts on leases the camera on Boyoali. This type of research used in this study is a descriptive study, which explains systematically and thoroughly about legal responsibility for camera rental in Boyolali. The approach used is a normative approach that will examine the legal aspects, legal rules relating to camera rent and legal liability if one party makes a mistake on the basis of default or illegal acts in the camera rental agreement in Boyolali. The results of this study indicate that the camera rental agreement process must meet administrative and legal requirements. After fulfilling these requirements, the lessee has to fill in a form or deed that has been made by the renting party, then the lessee has to sign the deed of the camera rental agreement in Boyolali as a form of agreement. With the signing of the deed, an agreement was reached between the parties, which would then lead to a legal relationship that gave birth to the rights and obligations for each party. If one party in the camera rental makes a mistake or does not carry out its rights and obligations, the party making the mistake must be held responsible. Legal liability occurs if one party makes a mistake on the basis of default as stated in article 1243 of the Civil Code or mistakes on the basis of unlawful acts as stated in article 1365 of the Civil Code.
