Abstract

The purpose of this research is to find out whether there are considerations of investigators in conducting or not detaining a criminal offense outside the subjective conditions contained in Article 21 paragraph (1) of the Criminal Procedure Code at the Solo Raya Regional Police Station. The reason of the investigator in making a detention or not carrying out detention when viewed from the subjective conditions based on Article 21 paragraph (1) of the Criminal Procedure Code is only limited if there is an investigator's concern that the suspect will flee, lose evidence, and / or commit another crime. The absence of clear boundaries causes decisions to depend on the judgment of each individual investigator. No detailed set of subjective conditions in making a detention results in the investigator having full authority to make or not make a detention. In practice, investigators often consider several reasons outside Article 21 paragraph (1) of the Criminal Procedure Code.
