Abstract

The times are one of the people who can make agreements that are increasingly developing. Forms of agreement that were originally only done in written form, are now experiencing developments due to the existence of a standard agreement system. In general, several companies have implemented standard agreements. From the existence of the standard agreement there is an exoneration clause which means that there is one party, namely the consumer who cannot and does not have the opportunity to negotiate or bargain when making a transaction. In this case, it can be said that the existence of a standard agreement creates an exoneration clause which basically can eliminate the principle of freedom and justice carried out by each party in entering into an agreement. So it can be judged that the exoneration clause does not provide validity in entering into an agreement including in justice between the business actor and the consumer.
