Abstract

Drug in human life cannot separated, because drug is important factor for healing many human’s diseases. Drug have many effect into human’s body, one of them is giving effect of hallucinations and make human addicted to drug. Drug that have hallucination effect used by most people for having fun not for medication purpose. Drugs that consume freely without doctor’s rules was not among narcotics and psicotropics. In Health Law, people who selling drug without license from government and production drug without fulfill the regulation standart can be punish in accordance with health law. But for people who consuming drug for having fun cannot be punish , but only can endure medic rehabilitation and social rehabilitation. Using drug for medication in Islam appropriate with Maqasid Asy- Syariah,Maqasid Asy-Syariah is 5 Islamic religious purpose to always maintain of human race. Consumin drug for curing the diseases is the form of keeping away to ensure continued healty. But drug abuse is inapplicable with Maqasid Asy-Syariah and breaking the Islam Law, because in Al-Qur’an and As-Sunnah consuming khamr’ or everything that can intoxicating is haram.
