Abstract

Outsourcing workers are workers who have a working relationship with an outsourcing service provider company by placing work in the work area of an outsourcing service user company that has previously engaged in a work relationship between an outsourcing service provider company and an outsourcing service user company. This study aims to determine the form and content of outsourcing work agreements at PT. Gatra Karya Utama and know the application of the legal rules regarding outsourcing agreements from the perspective of Law No. 13 of 2003 concerning Labor in the outsourcing work agreements of PT. Gatra Karya Utama. This study uses a doctrinal or normative approach. Descriptive research type. The results showed that the provisions regarding the form and contents of the agreement were in accordance with the provisions of the legislation article 66 of the Manpower Act and article 1320 of the Civil Code. The rules regarding outsourcing are regulated in the Labor Law articles 64 to 66. Regarding article 64 of the Manpower Act, the outsourcing agreement with PT. Gatra Karya Utama complies with statutory provisions. The practice of outsourcing at PT. Gatra Karya Utama complies with Islamic law.
