Abstract

At present the Bill on the Elimination of Sexual Violence is deemed not in accordance with Indonesia's positive law as well as the perspective of Islamic law. The purpose of this study is to describe the suitability of the Bill on the Elimination of Sexual Violence with positive laws in force in Indonesia and to explain the suitability of the concept of the Bill on the Elimination of Sexual Violence in the perspective of Islamic Law. The method of approach used in this study is a normative juridical approach or also called doctrinal law or library research. This type of research used is normative descriptive. The results showed that objections to the lack of detail in the Criminal Code and Criminal Procedure Code in regulating sexual violence became the basis for the need for the enactment of the Bill on the Elimination of Sexual Violence. In bridging the differences in perspectives on the presence of the PKS Bill which is still far from perfect both from an Islamic perspective, it would be more appropriate to take the adage from fiqh rules: ma la yudraku kulluh la yutraku kulluh.
