Abstract

The fulfillment of underage marriages is not permitted in the Marriage Law but has also been regulated in Article 7 paragraph (2) of Law Number 1 of 1974 concerning Marriage which has given authority to the Religion of Religion in providing the stipulation of marriage Dispensation. This study aims to analyze the parameters of the judiciary considerations of the Surakarta Religious Court in the provision of marriage dispensations and to find out the regulation of Islamic law in the community according to the scholars, Marriage Law and Compilation of Islamic Law; The author conducts this analytical descriptive research by using the normative-empiric approach method, analyzed using qualitative analysis methods; This study aims to find out the results of the discussion about the factors that cause a lot of marriage dispensation in the Surakarta Religious Court; as well as to find out the consequences of the provision of dispensation to marry. This study obtained results that showed that the Judges in considering the determination must be in accordance with the arguments and legal evidence petitioned, as well as considering the social value in terms of the benefits considered as the best solution is considered to provide policies that can solve the problems of the people.
