Abstract

This study aims to determine how motor vehicles as collateral in credit agreements at PT BPR Rejeki Insani in Klaten City through three things, namely by knowing how the legal construction of credit agreements with motor vehicle guarantees, knowing the legal responsibilities of the parties and knowing the problems that arise in the agreement motor vehicle loans. This research is a descriptive study, with the aim of providing as complete data as possible regarding the legal construction of credit agreements with motor vehicle collateral, the legal responsibilities of the parties and knowing the problems that arise in the loan agreement with motor vehicle collateral at PT BPR Rejeki Insani in Klaten City . The type of data used is primary data and secondary data. Primary data were obtained from the Business Manager of PT BPR Rejeki Insani, Klaten City, while secondary data were obtained from archives, documents, literature, and legislation aimed at supporting primary data. Data collection techniques used were field research and literature study. The field research was conducted through an interview with the Business Manager of PT BPR Rejeki Insani, Klaten City, while the study of literature was through literature, books, laws, archives and so on. The data analysis technique uses Qualitative techniques that refer to the legal norms contained in the laws and regulations of the court as well as the norms that live and develop in society. Based on the results of research and discussion conclusions are generated. First, the legal construction of a credit agreement with a motor vehicle guarantee is basically the same as granting credit with other guarantees, but for credit with a motor vehicle guarantee after the process at PT BPR Rejeki Insani, a Fiduciary Deed must be made before a notary public then registered at the Fiduciary Registration Office and produces a Fiduciary Certificate. . Second, the legal responsibility of the parties in the event of default and risk. Third, problems that arise are basically due to motorized vehicles being movable objects so that the value of the goods if guaranteed for too long the value of the goods will decrease from time to time.
