Abstract

Criminal provisions for repayment of state financial losses in a criminal act of corruption, which are regulated in Article 18 of Law Number 31 of 1999, provide alternative penalties in the form of criminal substitutes for convicts who are unable to recover state losses. Most corruption convicts choose to carry out criminal substitutes rather than return state losses. As a result, the corrupted state money is not repatriated, the nature of state losses cannot be overcome. This is a normative study with the aim of identifying laws related to norms that must be included in positive law. This research succeeded in formulating positive legal norm concepts related to strengthening criminal acts of corruption. The concept of the norm is seen as being able to regenerate the law of corruption eradication politics that is achieving economic justice.
