Abstract

The purpose of this study was to study the implementation of an unlawful pretrial detention examination in the Surakarta District Court and to find out what happened in the protection of the suspect or defendant regarding the validity of detention through pretrial. The research method used is to discuss the empirical juridical and the type of research used is descriptive research. The research location is the Surakarta District Court. Data technique consisting of qualitative analysis is a method that emphasizes more on aspects of understanding related to the problem. Based on the results of the research obtained by the data obtained in the Surakarta District Court, SA, ISB, AK and KM, asking for pretrial because the arrest of the applicant did not meet the requirements determined by law Article 21 paragraph (1) of the Criminal Procedure Code. Amar The decision of the Surakarta District Court consists of rejecting the respondent's exception, rejecting the Petitioner's Application for the Whole and Punishing the Applicant to pay a court fee of Rp. 3,000 (Three thousand rupiah).
