Abstract

Managerial support (supporting management) in the franchise agreement including; Providing business packages (operational materials) and training based on Minister of Trade Regulation No. 53 / M-DAG / PER. 8. 2012 concerning Franchise Organizers in Article 27 Paragraph (1). The protection of the parties in the Martabak Holland franchise agreement regarding supporting management includes; Regulations regarding criteria for franchising are clearly regulated in Article 3 PP No. 42 of 2007 concerning Franchising. The franchise agreement on the agreement of both parties can extend with the terms and time period to be determined later is the implementation of Article 4 of Government Regulation No. 42 of 2007 concerning Franchising. The parties defaulted on Article 14 of the agreement, including: If the franchisee is negligent and / or does not carry out the obligations stipulated in this agreement even though the franchisor has received a third warning but still commits a violation both differently and equally, which violations are considered serious as written in the warning letter or reprimand, compensation according to the size of the franchisor in accordance with the explanation of Article 1236 of the Civil Code.
