Abstract
This research is the result of field research about “Analysis of contract greetings on sale and fruit according to the persfektif Fatwa DSN-MUI No: 05/DSN-MUI/IV/2000 (case study in Sragen Bunder market)”, with the aim to answer the problem formulation, practice of contract greetings that occurs between a consumer with market traders in the Bunder Sragen is in compliance with Shariah Board Fatwa National Scholar Indonesia (DSN-MUI) No: 05/DSN-MUI/IV/2000?. The research data gathered by the method of interview with some consumers with some fruit traders in the market as well as Bunder Sragen, as well as the study of the literature using books, journals, and reports related to these problems. The data are then analyzed using qualitative method with deductive thingking based on a theory that is used to solve the problems of the masses. The results of this study concluded that : the practice of greeting the contract between the consumer market in the fruit merchant with Bunder Sragen does not comply with the decision of the Fatwa DSN-MUI number: 05/DSN-MUI/IV/2000 because there are some things that are distorted. Things diverge, “payment must be made at the time the contract is agreed.” In practice payment is done by cash advance system. Then in the Fatwa DSN-MUI must not be exchanged unless item with similar goods in accordance with the agreement. But the practice, the trader provides lower quality without telling the consumer because the fruits are booked is not available or does not forget the order buys. Fatwa DSN-MUI on the seller should submit the goods just in time with the quality and the amount that was agreed, it is not in accordance with the practice that is done by the existing market fruit traders Bunder Sragen because in practice he did not give fruit with good quality and at a time that was agreed upon because the goods are not availabke at this time. Fatwa DSN-MUI if the seller handed over the goods with lower quality, and buyers are willing to accept it, then he should not demand a reduction in price (diskon). This is not in accordance with the decision of the Fatwa DSN-MUI based on the results of an interview resource person (consumer) goods given quality but without informing in advance to the consumer. This is a follow-up cheating in business transactions. With respect to the conclusion above, here is the advice given : firstly, for merchants in the market of Bunder Sragen, it should implement the system of sale correctly, provide appropriate quality so that consumers do not feel aggrieved parties and become an honest trader. Second, for the consumer market in the Bunder Sragen. It is expected to be more careful in conducting the transaction from being harmed by the plurality of persons of traders who are not good.
