Abstract

A sale and purchase agreement is made based on an agreement between the two parties, namely the seller and the buyer. The sale and purchase agreement is carried out to achieve the objectives expected by each party. Sale and purchase agreements can be made in writing or verbally. In an agreement made in writing, if the agreement letter has been signed by both parties, then a legal relationship is born between the parties involved concerning rights, obligations and responsibilities in accordance with their respective roles. This study examines how the application of the principle pacta sunt servanda in the fertilizer sale and purchase agreement between CV. Subur Makmur with UD. Mulya Tani is seen from the implementation of the rights, obligations and responsibilities carried out by each party and also the responsibilities of the CV. Subur Makmur as a seller in the event of default. The research method used by the author is Descriptive Research with a Normative Juridical Approach. The technique of data collection was carried out by means of a literature study through data obtained from a fertilizer sale and purchase agreement between CV. Subur Makmur with UD. Mulya Tani and also additional data through interviews with CV. Subur Makmur and UD. Mulya Tani.
