Abstract

The purpose of this research was: 1) to figure out the problem often encountered by consumers in the process of buying and selling a home privately subsidized credit in Karanganyar area. 2) to know the shape of the legal protection of the consumer in the sale and purchase of subsidized home in Karanganyar area credit. 3) to find out how the resolution of problems arising in the process of buying and selling a home privately subsidized credit in Karanganyar area. Based on the results of the analysis of the obtained conclusions that: 1) the problems faced by consumers in the process of buying and selling a home privately subsidized credit in Karanganyar Area namely mismatch quality standards and technical specifications of the home, not the availability of public and social facilities that meet the standard, and that is not less important is the purchase agreement that is not balanced, with limitation of liability developer/developer. Consumers typically have a position of helplessness, both because of its position or because the laity against the legal aspects in General, in particular on the legal aspects of the agreement, as well as accepting only what is proffered developers. The Perjanjanjian does not reflect the aspirations of the interests of consumers. 2) form of legal protection of the consumer in the sale and purchase of subsidized home in Karanganyar area credit provided for in article 8 of law No. 8 Year 1999 about governing consumer protection acts that are prohibited for perpetrators the effort. 3) resolution of problems arising in the process of buying and selling a home privately subsidized credit in Karanganyar area can make a concerted effort to fight for the legal rights of consumers. Remedy which can be done by the consumer housing i.e. 1) Consumer dispute resolution outside the Court carried out by means of peaceful settlement by the parties to the dispute and the Dispute Settlement Body Consumer Disputes (BPSK). 2) Consumer Dispute Resolution Through Litigation Process. Housing consumers can submit a civil suit to the district court at the customer's place of residence. The basis of the claim that can be filed is an act against the law, against the verdict of the district court, can be appealed and then appealed, as usual civil cases.
