Abstract

ABSTRACT The need for a business place plays an important role in trading business activities to develop a business that is traded. However, not all businesses have their own businesses. With this, a business actor is required to lease a strategic place of business to someone who rents his place of business like a shop house. With the existence of such conditions causes the creation of a lease agreement to rent a shop. Therefore, in this study aims to determine the process of leasing agreements between parties that rent out shophouses with the tenants of the shop, regulations and the rights and obligations of the parties in making shop rental agreements, legal responsibility if one party defaults or illegal acts in the lease agreement to rent a shop that has been agreed by both parties. This research is descriptive qualitative because it will explain the legal responsibility of the lease agreement to rent a shop. The approach in this study, using the normative approach method because it will examine the rules in the lease agreement to rent a shop. In the results of the study showed that in the process of renting shop houses, the parties must obey the rules and fulfill administrative requirements as well as legal requirements. Then between the parties agreed to enter into an agreement by signing the deed of agreement, at that time there was a legal relationship that gave birth to rights and obligations. The right of the renting party is an obligation of the shopper's tenant, while the tenant's right is the obligation of the party who rents out. Therefore, both parties must comply with the applicable regulations, because if they violate there will be legal responsibility. Legal liability occurs if one of the parties makes a mistake in the form of interpretation stipulated in Article 1243 of the Civil Code and acts against the law Article 1365 of the Civil Code so he is required to compensate.
