Abstract

The issue of corruption in Indonesia is a complicated issue. Almost all lines of life have been infected by a corruption outbreak. Until now, corruption has become increasingly widespread and carried out in increasingly sophisticated and systematic ways. One of the methods or modus operandi of corruption is carried out today by using corporations as a means, subject and object of corruption. This study examines the criminal liability of corporations in criminal acts of corruption. The research method used by the author is a descriptive study with a normative juridical approach. The results of the research conducted by the authors can be concluded that in terms of criminal acts of corruption committed by corporations, it is regulated in the provisions of Article 20 paragraph (2). While from the sound of Article 20 paragraph (2) that in imposing criminal liability on corporations, the Law on the Eradication of Corruption Crimes adheres to doctrine of identification and doctrine of aggregation.
